Use of the Website
By accessing this website you agree to these terms and conditions (the "Terms"). If you do not agree to them you may not use this website and should leave it immediately.
We have taken great care to ensure that the Items on our website are presented as accurately as possible. However colour clarity will depend upon your own personal monitor and we therefore cannot guarantee that the colour of the actual Item is absolutely accurate. Before placing an order please read through these Terms.
By using this site you agree to comply with, and be bound by, these Terms.
We may from time to time modify the Terms at our sole discretion. By using this Website after any such change(s), you agree to comply with, and be bound by, the Terms as changed.
Making a purchase
When you order an Item from SARGOSSA.COM you are offering to buy it for the price stated, subject to these Terms.
You will be guided through the process of placing an order by a series of instructions on the Website. You place your order for Items from the Website by clicking on the [Confirm Order] button at the end of the on-line order process. At the same time you will complete an authorisation for us to recover, through your credit or debit card, payments due to us. Once you have placed your order, we will send you an email acknowledging the exact details of your order, providing you with a payment reference and the value of your order that will be debited from your credit/debit card. This is not an order confirmation or order acceptance from SARGOSSA.COM unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Returns policy set out below, our acceptance of your order and the completion of the contract between you and us will take place when you receive an email from us notifying you that we have dispatched the Items ordered by you.
We may not accept your order if (i) an item you have ordered is out of stock, (ii) your card is due to expire within 28 days of your purchase date, (iii) we are unable to obtain authorisation for your payment or (iv) if we identify a product or pricing error. Your order is an offer, not a contract of sale between you and Sargossa, so prices and stock availability won't be contractually confirmed until you receive the 'confirmation of dispatch' email, which will be sent out once credit card authorisation has been confirmed and stock levels have been checked. For the avoidance of doubt, the 'order confirmation' email that is sent out once you have placed an order is just an acknowledgement of your offer and should not be taken as our acceptance of that offer.
We reserve the right to reject any offer to purchase by you at any time and at our sole discretion. If we are unable to fulfill your order following our order acknowledgement, we will contact you by email or telephone advising you of this. See the Returns policy set out below. We will try to keep our Website as up to date as reasonably possible but cannot guarantee that any particular Item will always be available. If we can't supply any Item we will release the funds being held in your account for the purchase.
Price and Delivery
Your card will be charged in currency based on the place where the goods are to be shipped (e.g. a UK customer asking for the goods to be sent to the USA will be charged in US dollars). We charge customers either in pounds sterling, euros or dollars depending on the country of shipment as set out below. Prices are displayed to you when you enter the site in the currency we use for the country indicated by your computer's IP address. You may change the shipment country at any time and this will change the prices to the currency we use for that shipment country. Prices for shipment to the UK will be shown in pounds sterling. When you choose shipment to a different country other than within Europe (and certain dependent territories) this will normally be a price shown in Euros including for countries such as Russia. Where shipment is outside Europe to the North and South America including Canada and the Caribbean, prices are shown in US dollars. Prices for all other non-Europe/ USA shipments will be shown in pounds sterling. We convert from pounds to dollars and euros using daily currency conversion rates from XE.com. However, the price displayed to you at the checkout is the price you pay. This will not vary later whatever currency fluctuations occur. Refunds will also be set at the price you paid, not the price in the currency concerned at the date of refund. When you proceed to the checkout, your final price will appear in pounds sterling (as we are a UK based company all purchases are processed in pounds sterling.)
VAT: If you are in the UK and choose to have the goods shipped to the UK, prices will be shown inclusive of VAT (where applicable) at the current rate. If the country of shipment is outside the UK but within the EU and dependent territories, prices will be shown in euros inclusive of VAT. All other countries are shown a price excluding VAT as no VAT will be due on these orders.
Delivery to countries other than the US and Australia that are outside the EU may be subject to local import taxes, which are your responsibility (where applicable). If additional charges are to be incurred, the shipping company will contact you by telephone once your items are in customs to let you know the cost. It is your responsibility to pay the necessary charges at customs so that the local authorities release the goods and be aware that this may delay your delivery time. Sargossa is not responsible for any delays caused to delivery by outstanding import taxes.
We deliver to 227 countries: if we do not deliver to your country you will be prevented from selecting that country at the point of ordering.
We aim to deliver your chosen items to the place and person of your choice, in perfect condition and in the shortest possible time. We offer free worldwide delivery. We also offer an express same day delivery service within central London, which costs £12. Whilst in transit, all purchases are insured by us until they are delivered to you. If you wish to track your parcel, please refer to the email you were sent containing your tracking number or alternatively email us at customercare@sargossa.com and we will track your shipment for you. All shipments must be signed for.
Customer satisfaction is always our top priority, and as such we handle each query on an individual basis to the best of our ability. While we hope that you are delighted with your order, if you are not perfectly satisfied with your goods we will happily offer you a full refund or exchange.
All returns should be sent back to us in the original packaging provided. Please ensure when returning the parcel that the SARGOSSA box is properly protected with the plastic bag provided. Returns outside the 14-day window may be accepted at our discretion. The item(s) should be returned unworn and in perfect condition, with all SARGOSSA and designer garment tags still attached. Returns that are damaged, soiled or returned without their original labels will not be accepted and will be sent back to the customer. Before your parcel leaves our offices, it is fully checked and controlled by our packing team. If you receive an item that is damaged, please contact us immediately
Returning Goods from Non EU Countries
If you live outside the EU, you will also have received a Proforma Invoice with your package. This needs to be completed and enclosed with the items you wish to return. On this form you will need to indicate which item(s) are being returned by ticking the boxes alongside the product details. You will need to complete the Returns Number section with the number you have been issued and sign appropriately. All successfully returned items will only be credited to the account used originally to purchase the items, minus any taxes, import duties or original shipping charges incurred and will be refunded in the currency in which you paid at the price you paid at the exchange rate prevailing on the day when you bought the item. With exchanges, your new item(s) will be shipped to you as soon as we receive your returned package and any additional payment, which is required. Gift returns If you have received an item from SARGOSSA.COM as a gift you can exchange it for another item of the same value or more, provided you pay the cost difference and the additional shipping, taxes, and import duties, and any additional charges which may be incurred as a result of the exchange.
Payment SARGOSSA.COM allows orders to be processed online, or over the phone, using a valid credit or debit card. Your credit card company may undertake an additional security check to confirm it is you making the order. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
Refunds SARGOSSA.COM wants to ensure your complete satisfaction with the Items. For online purchases, we will accept Items not worn, used or damaged for a full refund as set out above.

General You acknowledge and agree that these Terms, together with our Privacy Policy, constitute the complete and exclusive agreement between us concerning your use of the Website and any purchase by you of any Items from SARGOSSA.COM, and supersede and govern all prior proposals, agreements, or other communications.
Privacy policy We will treat all your personal details as confidential and we will only disclose this information in the circumstances set out below. We will keep it on a secure server and we will comply with UK Data Protection legislation in relation to the use of your personal data. When you register on this Website or make a purchase, we will ask you to input and will collect personal details from you such as your name, e-mail address, billing address, telephone number. We may also collect, and our third party providers may collect, information about where you are on the internet (e.g. the URL you came from, IP address, domain types such as .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, any advertisements you may have clicked on, and any search terms that you entered on our Website. We confirm that any personal details that you provide to us (or which are available on public registers) and any user information, from which we can identify you, is held in accordance with the registration we have with the Information Commissioner's Office.
Intellectual Property Your use of the SARGOSSA.COM and its contents grants no rights to you in relation to any copyright, designs, trademarks and any other intellectual property and material rights relating to the Content (as described in the Content section below). You are permitted to use the Content only as expressly authorised by Sargossa Ltd and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties.
Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. However, you are permitted to make one copy for the purposes of viewing Content for your own personal use.
CONTENT In addition to the Intellectual property rights mentioned above, "Content" is defined as any photographs, graphics, including all image rights, sounds, music, video, audio or text on this Site.
LEGAL GOVERNANCE These legal terms shall be governed by and interpreted in accordance with the courts of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction to hear all disputes arising in connection with these conditions.
This current version Terms of Use shall begin to be effective as 30th May 2014.
